Terms and Conditions – OYKO

1. Definitions

In these Terms and Conditions:

  • Cooling-off period: the 14-day period during which a consumer may exercise the right of withdrawal.

  • Consumer: any natural person who is not acting for commercial or professional purposes.

  • Trader / Seller: OYKO, the company offering products for sale worldwide.

  • Distance contract: any contract concluded between OYKO and a consumer via an online sales system.

  • Durable medium: any tool allowing storage of information for future reference (e.g. email or PDF).

  • Right of withdrawal: the statutory right of consumers within the EU to cancel a purchase within 14 days.

  • Working day: Monday through Friday, excluding official public holidays in the Netherlands.

OYKO is registered and operates under Dutch and EU law.


3. Scope of Application

  1. These Terms and Conditions apply to every online offer, order, and contract concluded between OYKO and the consumer.

  2. By placing an order, the customer agrees to these Terms and Conditions.

  3. OYKO may update these Terms from time to time. The version published on the website at the time of purchase applies to that transaction.

  4. If any clause is deemed invalid, the remainder remains in force, and the invalid clause will be replaced by one that most closely reflects the intent of the original.


4. The Offer

  1. All product descriptions and images are provided as accurately as possible. Minor variations in color, material, or packaging may occur.

  2. Obvious typing or pricing errors do not bind OYKO.

  3. Each offer includes the total price (inclusive of applicable VAT) and any additional costs such as delivery fees.


5. The Contract

  1. The purchase contract is concluded once the customer completes the online order process and OYKO confirms the order by email.

  2. Orders placed without payment confirmation may be cancelled by OYKO.

  3. All electronic transactions are secured by appropriate encryption and payment-processing technology.

  4. OYKO reserves the right to refuse an order if there are legitimate reasons, such as suspected fraud, non-payment, or export restrictions.


6. Right of Withdrawal (EU Consumers)

  1. EU consumers have the right to withdraw from the contract within 14 days after receiving the goods, without giving any reason.

  2. To exercise this right, you must notify us by email at oykotechnologie@gmail.com within the 14-day period.

  3. After notification, you must return the goods within 14 days.

  4. Returned goods must be unused, undamaged, and in the original packaging with all accessories included.

  5. The consumer is responsible for return shipping costs unless the item is defective or incorrect.

  6. OYKO will refund all payments, including the original standard shipping charge, within 14 days after receiving the return.

  7. Refunds will be processed via the original payment method.

  8. You are liable for any reduction in value resulting from handling beyond what is necessary to establish the nature and functioning of the product.

  9. The right of withdrawal does not apply to:

    • custom-made or personalized goods;

    • goods sealed for health or hygiene reasons once unsealed (e.g. used water filters);

    • digital content or gift cards.


7. Returns Outside the EU

For customers outside the European Union, OYKO offers a 14-day goodwill return policy, following the same procedure as above. Local customs duties or taxes paid at import are not refundable by OYKO.


8. Delivery and Performance

  1. Orders are shipped worldwide from the Netherlands. Delivery times vary by destination.

  2. Delivery is considered completed once the parcel is delivered to the address provided by the customer.

  3. OYKO is not responsible for delays caused by customs, natural events, or incorrect address details supplied by the customer.

  4. If delivery is delayed or a product becomes unavailable, the customer will be notified promptly and may cancel the order for a full refund.

  5. Risk of loss passes to the customer upon physical receipt of the goods.


9. Prices, Taxes, and Payment

  1. All prices are shown in euros (€) and include VAT for EU orders unless otherwise stated.

  2. Non-EU customers are responsible for any import duties, taxes, or customs fees in their country.

  3. Payment is due at checkout using the available secure payment methods.

  4. If payment fails or is reversed, OYKO may suspend or cancel the order.

  5. OYKO reserves the right to update prices at any time before purchase confirmation.


10. Warranty and Product Conformity

  1. All products sold by OYKO are subject to the legal two-year warranty required under EU law.

  2. OYKO guarantees that goods conform to the contract and are free from manufacturing defects at delivery.

  3. The customer must report any defect or non-conformity as soon as possible, preferably within 14 days after discovery.

  4. The warranty does not cover damage resulting from misuse, neglect, or unauthorised repairs.

  5. If a product is defective, OYKO will repair, replace, or refund it at no cost to the consumer.


11. Complaints and Dispute Resolution

  1. Complaints can be submitted by email to oykotechnologie@gmail.com, including order number and description of the issue.

  2. OYKO will respond within 14 days. If more time is required, the customer will be informed of the expected resolution period.

  3. If a complaint cannot be resolved amicably, EU consumers may use the Online Dispute Resolution (ODR) platform: http://ec.europa.eu/odr.

  4. Submitting a complaint does not suspend payment obligations unless explicitly agreed by OYKO.


12. Limitation of Liability

  1. OYKO is not liable for indirect, incidental, or consequential damages, including loss of profit, arising from the use of its products.

  2. Nothing in these Terms excludes liability for death, personal injury, or intentional misconduct where such limitation would be unlawful under applicable law.


13. Governing Law and Jurisdiction

  1. All contracts between OYKO and customers are governed by Dutch law.

  2. Consumers within the EU may also invoke the mandatory consumer-protection provisions of their own country.

  3. Disputes shall be submitted to the competent court of the consumer’s place of residence or, at the consumer’s choice, to the court in The Hague, Netherlands.

  4. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.


14. Additional Provisions

  1. Any deviation or additional clause shall not disadvantage the consumer and must be documented in writing or electronically.

  2. In case of translation, the English version shall prevail for interpretation purposes.
